1. Scope of the Privacy Policy:

This Privacy Policy relates to Ten Cap PtyLtd. This Privacy Policy explains how we collect, hold, use, disclose and protect your personal information as bound by the Australian Privacy Principles(‘APPs’) in the Privacy Act 1988. 

2. Collection of Personal Information

When you invest in a financial product offered by Ten Cap or visit our website, personal information about you (such as your name, address, DOB, email address, bank account information and government issued identification numbers such as your TFN may be collected through avariety of different ways, including directly from you, via a nominated agent (such as a financial advisor, agent or attorney), third party (such as a government data base) for the purpose of complying with “know your client” requirements or via our web site.

3. Use and Disclosure of Personal Information:

When Ten Cap collects personal information from you, we will inform you of the purpose for which it is collected and to be used. This information may be used to establish and administer your investment, comply with specific and/or relevant laws or is required to communicate with you about your investment with Ten Cap. The processing ofan application / redemption could be delayed / refused if the required information is not provided as required by Ten Cap or to satisfy legal requirements.

Ten Cap may need to disclose personal information to another person and/or organization. However, we will only disclose this information if permitted by law and we have your express, or implied, consent, or it is required by law. We will not disclose or use your personal information for any purpose than what it is collected for.

At times, and because Ten Cap operates across Australia, we may disclose your information outside of the state or territory you reside. In addition, because Ten Cap uses third party administrators and registries to support its operations, we may need to provide your personal information to these providers but in accordance with privacy laws.

We do not collect information that is categorized as sensitive (such as criminal or health records) unless it is required for business purpose. All information collected will only be used or disclosed in accordance with privacy laws.

5. Protecting Personal Information:

Ten Cap will take all reasonable steps to protect your personal data. This includes misuse, loss, modification,disclosure or unauthorized access. We will destroy personal information if it is no longer required for the purposes of its collection. We take all reasonable steps to protect your personal information from misuse, loss, unauthorized access, interference, modification or disclosure. We take all reasonable stepsto secure your personal information either via physical or electronic access.All information is restricted to only those whose job will require access.

6. Complaints and changes to the Privacy Policies:

If you believe your personal data hasbeen mishandled and this is in breach of privacy principles, then you may lodgea written complaint with us. Please address any complaint to the Privacy Officer (see details below). Over time, there may be revisions made to our Privacy Policies.
